Terms of Service

Article 1 (Application)

These Terms of Service (these “Terms”) set out the conditions for use of JVW3 (Japan Vintage World Wide Web, the “Service”), provided by Tulipa Design LLC (合同会社Tulipa Design, the “Company”). By using the Service, a user is deemed to have agreed to these Terms.

Article 2 (Nature of the Service)

1. The Service is a platform for research, accumulation of source material, and community relating to vintage and collectible items.
2. Identification results and results of AI analysis on the Service are opinions based on the observations and sources referred to. They are not certificates of appraisal guaranteeing authenticity, age, value or the like.
3. The Company is not a contracting party, a payment intermediary or an escrow agent with respect to sales or other transactions between users. Indications such as “available to transfer” are expressions of intent made by the user themselves. The Company is not involved in, and does not guarantee, the formation or performance of a transaction, authenticity, payment or delivery.

Article 3 (Accounts)

1. Please keep your registration information accurate and manage your own authentication credentials.
2. The Company is not liable for damage arising from unauthorized use of an account.

Article 4 (Prohibited Conduct)

• Conduct that violates laws or public order and morals
• Intentionally registering false sources, observations or identification information
• Harassment of other users, impersonation, or improper manipulation of reputation
• Posting that infringes the intellectual property rights or privacy of a third party
• Conduct that interferes with operation of the Service (unauthorized access, excessive automated access, and the like)

Article 5 (Posts and Content)

1. Rights in posted content belong to the poster. The poster grants the Company permission to use it to the extent necessary to provide and improve the Service (storage, display, reproduction for search, and the like).
2. Because the Service is a knowledge base in which sources, identifications and evidence cross-reference one another, published posts and contributions may be retained after withdrawal in an anonymous form detached from the individual. For details, please see the Privacy Policy.

Article 6 (Paid Plans)

1. The content and the price of paid plans are as displayed on the applicable sign-up page.
2. You may cancel at any time from your account settings. For details, please see the Legal Notice under the Act on Specified Commercial Transactions.

Article 7 (Change and Suspension of the Service)

Where the Company deems it necessary, the Company may change the content of the Service or suspend its provision, upon prior notice to users (except in the case of an emergency).

Article 8 (Disclaimer)

The Company is not liable for damage arising from use of, or inability to use, the Service, except where the Company is intentionally at fault or grossly negligent. Even where the Company is liable, the scope of that liability is limited to the total amount of usage fees received from the relevant user during the preceding 12 months.

Article 9 (Amendment of These Terms)

The Company may amend these Terms as necessary. Material changes will be announced on the Service.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. The Kobe District Court shall be the exclusive court of first instance by agreement for disputes concerning the Service.

Language

This document may be provided in languages other than Japanese for convenience. In the event of any inconsistency between the Japanese version and a translated version, the Japanese version shall prevail.
